I’m Russell Shackleton and I am a qualified Civil & Commercial and Workplace mediator (through the Civil Mediation Council - CMC). If you need help to resolve a dispute then in the majority of cases you will be working solely with me.
Mediation in general has a 75% settlement rate, my settlement rate currently is 87%. Clearly it is the parties that agree to a settlement but I like to think that my professional , structured and warm approach is also a significant contribution.
I have a network of qualified and experienced mediators so if your dispute is too large or complex I can bring another mediator to help resolve your dispute. This can either be to co-mediate, which can help in complex disputes where the dispute involves more than 2 parties or if a specialist area of knowledge is needed.
I am also an experienced trainer, qualified Internal Auditor and Fraud Investigator and Non-Executive Director. I know how the questions to ask to get to the base of the issue and to understand its complexities; I know how to efficiently digest complex information and to see ways that can lead to a solution. I am comfortable interacting with people in all walks of life. I understand how to analyse numbers and accounts and I bring a high level of personal integrity to mediation.

How do my values fit into dispute avoidance and resolution?
EMPATHY: I understand that virtually no one wants to be involved in a dispute. A dispute eats up energy, takes precious time away from the things you would rather do, cost money to continue with and often to resolve and affects you and those around you.
HONESTY & INTEGRITY: I am true to myself and others, I have a high level of personal integrity and I will be honest both in what I can tell you and in what I am not authorised to tell you.
DETERMINATION: I will work tirelessly to find a way to resolve your dispute, I will be equally determined to challenge you to be innovative to think of ways out of the dispute that can be accepted by everyone.
What is Mediation?
Mediation is about closing the gap between you and the other person or organisation that you disagree with - the technical term is “parties in dispute”.
Working with all the parties my aim is to help close the gap to resolve the dispute. Research from the Annual Mediation review show that around 75% of disputes get resolved in mediation on the day. With that percentage increasing to around 90% within 2 weeks of the mediation as a result of greater understanding.

Mediation is split into 3 broad groupings:
Civil and Commercial Mediation
There are special Civil & Commercial mediation training courses accredited by the Civl Mediation Council.
‘Civil and Commercial’ includes all aspects of dispute resolution that are not mentioned in either “Workplace” or “Family’ mediation. This can include disputes relating to ‘Civil Partnerships’ as these form part of ‘Civil Mediation’.
The techniques used for Civil & Commercial mediation are different to those used in either “Workplace” or “Family Mediation”.
I have completed CMC accredited Civil and Commercial Mediation training so I am qualified to provide all aspects of Civil and Commercial Mediation.
Workplace Mediation
There are special Workplace mediation training courses accredited by the Civil Mediation Council.
‘Workplace’ includes all aspects of dispute resolution that occur in the Workplace or relate to employment.
The techniques and processes for Workplace mediation are different to those used in either Civil/Commercial or Family Mediation.
I have completed CMC accredited Workplace Mediation training and I am qualified to provide Workplace Mediation.
Family Mediation
There are special Family mediation training courses accredited by the Family Mediation Council.
‘Family’ includes all aspects of dispute resolution relating to families with the exception of inheritance/probate and power of attorney related disputes. The focus is on divorce, separation, children and education related disputes.
The techniques and processes for Family Mediation are different to those used in either Civil/Commercial or Workplace Mediation.
I am NOT trained to provide Family Mediation, though I can recommend “Austin Chessall’; he is an excellent experienced family mediator.
When is it best to go to mediation?
At an early stage in a disagreement mediation can help to prevent the gap becoming too big to cause a serious dispute. This is especially important if after the dispute you need to have a continued relationship - eg: if you are related, work together, do business together or have children.
Mediation works best for all parties if you can agree to mediation at an early stage as you WON’T be accumulating large legal fees, or using precious time and mental angst in the dispute.
If you can’t agree to mediation at an earlier stage, then you can still agree to a mediation later, though the question of who and how the higher costs are paid for can often complicate the mediation.
The mediation can take place as soon as each party has time and there is a venue (if the mediation is face to face) so even at a later stage mediation can be a faster alternative to formal legal action.
When Mediation may NOT be the most effective solution?
If all the parties do not agree to mediation - just as it takes 2 to tango; so it needs all parties to voluntarily take part in the mediation and commit to a solution for it to work.
If you can’t agree on a truly independent mediator to carry out the mediation.
If the value of the dispute is smaller than the cost of the mediation fees to resolve the dispute. Commercial mediation is often around £120 per hour, and even the least complex dispute is likely to take at least a couple of hours to resolve..
What if Commercial Mediation isn’t appropriate for my dispute?
If your mediation doesn’t fit into the scope of Commercial Mediation, there are Charitable Community Mediation Organisations in most towns and cities. These can often mediate either for free or for the price of a voluntary donation.
Community mediation can also work for such things as neighbour disputes over behaviour or boundaries.
Community mediation is often performed by new mediators seeking experience or experienced mediators looking to help the community or to gain more practice.
You can also ask me or any commercial mediator if they do Pro-Bono community type mediation so depending upon the complexity some mediators including me may be willing to do this.
