How much can I expect to pay for a Mediation and what are the terms?

Please call us to discuss your dispute, we provide a FREE 30 minute telephone discussion and can give you a price once we understand more about the history, and complexity of your dispute.

We can also discuss the best location or format for the mediation, and if there will be any additional fees for the venue, travel or administration.

If you arrange your mediation directly with Shackleton Mediation Plus: in many cases we can provide you with TWO mediators at NO extra cost to you. We find that this can enable a mediation to be completed faster, and for us to provide a mediator with a better technical understanding of the subject as well as a legal knowledge. The use of TWO mediators can in some cases complicate things or put one party on edge which is why we do not have TWO mediators for all mediations.. In many cases ONE mediator is the better option.

When TWO mediators are used depending on circumstances, one or both of the mediators may be mediating virtually (via zoom), we will inform and agree this with the parties (or their representatives) in advance.

What does my mediation fee include?

  • Pre-mediation call with each party (or if you prefer with your professional advisor (though it is best for us to speak to you).

  • Pre-mediation administration / communication.

  • My specially designed pre-mediation pack to help you prepare yourself and structure your needs for the mediation.

  • Review of documentation and any other information provided prior to mediation (within defined volume).

  • My total focused attention during the mediation - I will be speaking with you or the other party or moving between each party for the full length of the mediation.

  • My time at the mediation whilst the ‘heads of the agreement’ are written - this is the principles of the settlement before it goes into “legaleeze”!

  • Email or telephone call after the mediation to see that the agreement is being followed - if the parties want me to.

How do you calculate your prices?

The fees quoted to you will be the TOTAL fees you will be asked to pay for the mediator’s services. There are no additional booking or administration fees. We only charge for the mediators preparation and mediation time and on occasions the cost of travel and hotels. We do not charge for anything that you have not been informed of first, and we do not charge travel time for any mediation in the UK, Channel Islands, Isle of Man, Ireland or mainland Europe.

Mediation fees are based on the time and complexity of the mediation and NOT the size of the sums/monies in dispute.

  1. All our Mediation fees are priced per party and exclude VAT.

  2. It is standard practice that each party pay the mediation costs between them. This helps each party to be committed to the successful outcome of the mediation, and also helps promote the independence and equal commitment to both parties of the mediator.

  3. Fees are dependent on the complexity and nature of the mediation.

  4. A short mediation can be completed in 1 to 2 hours.

  5. A standard mediation usually takes either a half or full day.

  6. Mediation fees include up to 2 hours preparation time.

We offer fair value and believe that our prices are highly competitive. All prices will be clear and agreed with both parties prior to the mediation, we recognise that a Mediation often brings surprises and our prices should not be one of them!

  • Hourly rates range from £125 per hour and £200 per hour per party

  • Half day rates for a 4 hour mediation range from £500 to £1000 per party

  • Full day rates for an 8 hour mediation range from £800 to £1500 per party

In the relatively unusual event of a mediation extending beyond the agreed length, further time is charged at the hourly or half day block rate. The fees are charged in a pragmatic way, so if we can see that agreement is extremely close we will at our discretion wave the additional fees.

Terms:

  1. Invoices are payable within 14 days of the date of issue or 3 working days prior to the date of the mediation - Whichever is the Soonest.

  2. Where an invoice is issued to and payable by the solicitors’ firm instructed by a Party, settlement of those invoices is not conditional on them being in funds from their clients. The same applies to invoices issued to mediation providers.

  3. Where a Party does not have a solicitor representing them the invoice will be addressed to and payable by the Party itself in advance of the mediation.

Cancellations:

If any of the Mediation Parties cancels the Mediation, the following proportion of the Mediator Fee will be payable by each Party:

  1. If the cancellation is made two or less working days before the date of the Mediation, the full Mediator Fee including any preparation time; or

  2. If the cancellation is made three to five working days before the date of the Mediation, 50% of the Mediator Fee including any preparation time; or

  3. If the cancellation is made six to ten working days before the date of the Mediation, 25% of the Mediator Fee with no preparation time;

in each case without prejudice to a Party’s right to recover such sums from any Party it may consider to be at fault for the cancellation. Any travel or accommodation charges which mediator has to incur will also be fully chargeable.

COVID Cancellations:

 

  1. We do not want any mediation that we undertake to become a ‘spreader event’ for Covid-19.

  2. If anyone involved in the mediation - as a party, advisor, mediator, or observer either tests positive for Covid-19 or has symptoms of Covid-19 in the week prior to the mediation we will accept a cancellation without any fees being due to the mediator providing that the mediation takes place within 2 weeks of the initial scheduled date.

  3. If all parties prefer, the mediation can be moved from being at a physical location to being a virtual (zoom) mediation.

In both points 2 and 3 above if any travel or accommodation fees have been incurred by the mediator which are not refundable; the mediator will charge these fees to the parties in the mediation.
